In December 2004, the Saint Louis District Office of the EEOC filed this lawsuit against UMB Bank Financial Corporation, doing business as UMB Bank, in the U.S. District Court for the Western District of Missouri alleging discrimination on the basis of disability in violation of Title I of the Americans with Disabilities Act of 1990 and Title I of the Civil Rights Act of 1991. Specifically, the complaint alleged the defendant failed to hire the complaining party, a quadriplegic, in their sales department. The complainant intervened in the lawsuit in December 2004. Following discovery and a failed partial motion for summary judgment by the EEOC, the lawsuit was tried by a jury in January 2007. The jury found in favor of the defendant and awarded $11,478.87 in costs against the plaintiffs. The complaining party appealed the decision to the U.S. Court of Appeals for the Eight Circuit in August 2007. The Court of Appeals has not reached a verdict at the time the information was collected; therefore, the final outcome of the appeal is unknown.
