In January 2005, the EEOC district office in Birmingham, Alabama brought this suit against Renal Care Group, Inc. in the U.S. District Court for the Southern District of Mississippi. The complaint states that the defendant, in violation of Title VII of the Civil Rights Act of 1964, disciplined and ultimately terminated a black employee because of her race and because she had complained about the discriminatory treatment being suffered by another black nurse.

The defense moved for summary judgment, but the motion was denied. The parties settled the case and a consent decree was entered in April 2007. The parties agreed that the defendant would pay the aggrieved employee distribute EEO notices to all of its employees, refrain from retaliating and discriminating on the basis of race, provide EEO training for all of its employees, and post EEO notices in its Jackson facility. The former employee entered a separate settlement agreement with the defendant.
