The Baltimore Office of the EEOC brought this suit against W.H. Emmart & Son, Inc., dba Bo's Belly Barn, in the United States District Court for the Western District of Virginia in September 1998. Because the trial docket is the only document available, the type of discrimination alleged is unclear. The Defendant moved to dismiss the case, which was granted in part and denied in part. There was also a contested discovery motion and an unsuccessful mediation session with a magistrate judge. The trial docket indicates that there was a judgment of $260,000 for the complainant(s) in October 2002, which was the result of a judgment on a jury verdict.
