The New Orleans (along with the Houston) office of the EEOC brought this ADA suit against Ampace Freightlines, Inc. d/b/a Merchants Dutch Express, in May 1999, in the U.S. District Court for the Western District of Louisiana. The complaint alleged that the defendant discharged the charging party because he was regarded as having a disability. More specifically, the defendant allegedly discharged the defendant from his job as a truck driver because he had "lazy eye."
