In August 2005, the EEOC district office of Memphis, Tennessee brought this suit against Randstad North America, L.P. in the U.S. District Court for the Western District of Tennessee. Although the complaint is not currently available, the consent decree states that the allegations concerned a claim of retaliation, in violation of Title VII of the Civil Rights Act of 1964, due to the defendant's failure to recall the aggrieved employee for other job assignments after she complained of sexual harassment. After filing a complaint with the court, the parties agreed to settle the case.

The consent decree states that the defendant will (1) refrain from retaliating against any employee because he or she opposed an unlawful employment action or decision; (2) provide employment discrimination awareness training to all of its non-temporary personnel for no less than two hours; (3) continue to conspicuously post Title VII notices as required by the EEOC; (4) pay the aggrieved employee $4,500 in back pay and $8,000 in compensatory damages; (5) make every effort to place the aggrieved employee into her former position, or a comparable one, with pay no less than she earned prior to this litigation; and (6) expunge all references to this litigation from its personnel records. The settlement term was three years. The docket sheet does not show any further enforcement; the case was presumably closed in 2008.
