On July 21, 1978, Arkansas inmates filed a pro se class action lawsuit under 42 U.S.C. § 1983 against the Arkansas Department of Corrections in the U.S. District Court for the Eastern District of Arkansas. The prisoners alleged that their constitutional rights had been violated by the Arkansas prisons' hair length requirements, which conflicted with the exercise of their religious beliefs. In 1979, the parties entered into a settlement agreement, in which the defendants agreed that no standard hair length or styles would be required of the inmates.

In 1998, the Arkansas Department of Corrections enacted a new grooming policy, which standardized hair length and prohibited beards. On April 29, 1998, members of the 1978 class action lawsuit moved for contempt or breach of the settlement agreement; defendants responded by asking the court to terminate the settlement agreement pursuant to the Prison Litigation Reform Act (PLRA) of 1995. On November 24, 1998, Magistrate Judge H. David Young recommended that the court decide for the defendants. On December 9, 1998, Judge Henry Woods agreed, and terminated the settlement agreement. The plaintiffs appealed the termination.

On December 6, 1999, the U.S. Court of Appeals for the Eighth Circuit (Judge Pasco M. Bowman II, Judge George G. Fagg, and Judge Diana E. Murphy) issued a per curiam opinion affirming the district court's termination of the settlement agreement. Jones v. Mabry 205 F.3d 1346 (8th Cir. 1999).
