On November 7, 1980, the U.S. Department of Justice (DOJ) initiated an investigation into the conditions at the Rosewood Center in Owings Mill, Maryland, pursuant to 42 U.S.C. §1997, the Civil Rights for Institutionalized Persons Act (CRIPA). On February 19, 1982, after the investigation, the DOJ issued a findings letter detailing the conditions that they believed to be unconstitutional. They found inadequacies in the areas of programming, staffing, abuse and neglect, environmental conditions, and resident placement.

On January 17, 1985, the DOJ filed a lawsuit over the aforementioned unconstitutional conditions under CRIPA against the state of Maryland in the U.S. District Court for the District of Maryland. At the same time, they presented the court with a consent decree agreed upon by the parties to the lawsuit, and the court adopted it as the court's order in the case. The consent decree provided for changes in the areas of medical care, training and basic self-care skills for residents, staffing, record keeping, behavior management, restraints, personal safety of residents, and classification and placement procedures.

On June 4, 1986, the court approved a stipulated modification of the consent decree. The modification provided for reorganization of the management structure at the Rosewood Center, as well as new training programs.
