In approximately 1984, a child incarcerated at a jail of the Navajo Nation in Window Rock, Arizona, filed a lawsuit against the Division of Public Safety of the Navajo Tribe. In a Consent Decree filed in the District Court of the Navajo Nation in Window Rock, Arizona, dated January 28, 1985, the court enjoined the Tribe from incarcerating juveniles under age 18 in jails where adults were housed. The Decree further required the defendants to submit a plan for a juvenile detention facility to the court within thirty days of the decree, and to refrain from committing children to nearby jails which did not conform to recognized standards for proper juvenile treatment.
We have only the Consent Decree for this case, so we have no further information.
