On July 19, 1993, the United States Department of Justice instituted an investigation under the Civil Rights of Institutionalized Persons Act ("CRIPA"), 42 U.S.C. § 1997, of the conditions of the Grenada County Jail in Grenada, Mississippi. The government released its negative findings to the Jail on October 18, 1993, finding that both pretrial and sentenced inmates of the Jail were subjected to conditions that violated their due process rights under the Fourteenth Amendment. Specifically the government found that 1) security and supervision at the Jail were inadequate, 2) medical and mental health care and suicide prevention were seriously deficient, and 3) there were serious environmental health and safety deficiencies at the Jail. The government recommended subsequent remedial measures.
According to the docket, for nearly ten months, there was no procedural history. In August 1994, the parties filed a consent decree in the United States District Court for the Northern District of Mississippi, setting forth provisions for a new jail facility that would implement the remedial measures recommended by the government. On November 14, the government filed a complaint under 42 U.S.C. § 1997 in the Court alleging the violations found in the CRIPA investigation mentioned above, and prayed for permanent injunctive relief. Also in November, the parties submitted both the consent decree and the complaint to the Court seeking orders of the Court. The Court (Judge Neal B. Biggers, Jr.) signed off on the consent decree on November 17, 1994. The case was subsequently reassigned to Magistrate Judge S.A. Alexander and closed on May 3, 1995.
