This lawsuit is a class action challenge to New Hampshire's mental health system, filed 2012, in the U.S. District Court for the District of New Hampshire. The Plaintiffs, individuals with mental illness, allege that the state's inadequate services lead to unnecessary institutionalization primarily in two state psychiatric hospitals, New Hampshire Hospital and the Glencliff Home. They claim that the inadequacies in mental health services amount to violations of the Americans with Disabilities Act, Section 504 of the Rehabilitation Act, and the Nursing Home Reform Act. The Plaintiffs are represented by the Bazelon Center for Mental Health Law, the Center for Public Representation, the New Hampshire Disabilities Rights Center, and Devine Millimet.

The U.S. Department of Justice had earlier investigated the issues raised by this lawsuit and detailed its findings in an April 2011 letter. DOJ found that the state is lacking in community-based services that would allow individuals with mental illness to avoid institutionalization. It found that many individuals who could live in the community currently reside in institutions or stay much longer than they need to because the supports available upon discharge are insufficient. After this lawsuit was filed, the United States received the court's permission to intervene and filed its complaint in intervention on April 4, 2012.

On June 11, 2012, the court (Judge Steven J. McAuliffe) declined to grant the Plaintiffs' first motion for class certification, instead recommending that the parties proceed to discovery in order to gather the facts necessary to certify the class. The parties have proceeded with discovery since that time. The Plaintiffs submitted a renewed motion for class certification on January 29, 2013. That motion is currently pending before the court.
