SUMMARY: On October 4, 2006, California Governor Schwarzenegger issued a "Prison Overcrowding State of Emergency Proclamation," describing California's prison overcrowding crisis. Following the Proclamation, the State contracted with two prison companies and began moving several thousand prisoners out of California. (The lawfulness of the Governor's proclamation was subsequently challenged in the state court case California Correctional Peace Officers' Association v. Schwarzenegger--PC-CA-36 in this collection.).

Under the Prison Litigation Reform Act, a population cap on a prison or a prison system may be entered only by a specially constituted three-judge district court. In both Plata, which deals with prison medical care, and Coleman, which deals with prison mental health care, soon after the Governor's proclamation, plaintiffs' counsel filed a motion to convene a three-judge district court to impose a prison population cap. (A similar motion was filed in Armstrong v. Schwarzenneger [PC-CA-0001], a large-scale prisoner disability discrimination case, but in that case, Judge Claudia Wilson denied the motion without prejudice to its resubmission.) Attorneys for the plaintiffs sought a reduction in prison population reduced from over 160,000 inmates to 110,000.

In both Coleman and Plata, the district judges consolidated the three-judge-court motions and after a hearing on June 27, 2007, granted them. The State attempted an appeal, but the Ninth Circuit Court of Appeals, by order dated September 11, 2007, dismissed the appeal on the grounds that the Appeals Court lacked jurisdiction as the appeal was premature. The district court panel convened by Ninth Circuit Chief Judge Mary Schroeder to decide the overcrowding issue consisted of Judge Karlton, from Coleman, Judge Henderson, from Plata, and Judge Reinhardt, selected at random from the 9th Circuit.

After substantial litigation on intervention, discovery, a refereed settlement process that failed, and a 14-day bench trial, on February 9, 2009, the three-judge court issued a "tentative ruling" announcing its intention to rule in favor of the plaintiffs, and require California to reduce overcrowding from 190% of design capacity to something in between 120% to 145% of design capacity, over the next two or three years. If no new prisons are built, this would mean a reduction of something like 55,000 prisons. The court invited the parties to negotiate a settlement in light of the tentative ruling.

California declined the invitation to negotiate, and requested the three-judge court to issue a final ruling. On August 4, 2009, the three-judge district court issued an opinion that imposes a population cap on California's prisons. The court found that the cap was necessary to cure the constitutional violations that have long existed with respect to the provision of medical and mental health care. Considering the strict requirements of the Prison Litigation Reform Act for entry of a population cap, the court found (as required by the statute as a prerequisite to such an order) that overcrowding is the primary cause of these violations. It approved a population limit of 137.5% of design capacity, and it ordered the state to submit a plan as to how best it can reduce the current prison population from its present level of more than 190% of design capacity. No immediate release of prisoners was ordered. Rather, the three-judge district court ruled, the reduction in prison population of over 40,000 could be accomplished by the state over a two-year period, through a combination of various measures previously recommended by numerous state commissions and committees, and chosen by the state. For example, the state could, if it chose, release some non-dangerous prisoners early, or could shorten parole revocation terms, or could send some prisoners to county jails.

The PLRA requires courts considering population caps to assess the impact on public safety. The court found that the overcrowding in the prisons led to "criminogenic" conditions, which resulted in more crimes being committed by former prisoners and an increase in the recidivism rate. It also determined that, with adequate safeguards and improved rehabilitation and re-entry programs, the state could ensure that the order would result in an increase in public safety. The three-judge court stayed its population order pending appeal.

California appealed directly to the Supreme Court, as is normal practice in three-judge-court cases. After full argument, the Supreme Court affirmed the order in a five-to-four decision with a majority opinion by Justice Kennedy. Brown v. Plata, 131 S.Ct. 1910 (2010). The three-judge court made its population order effective as of July 27, 2010.

In response, California implemented prison "realignment," sending minor offenders to jail rather than prison and altering parole rules to shorten parole violation terms and have them served in jail rather than prison. As of early 2013, in-state population was down to 119,000; to meet the court order, population needs to drop an additional 17,000, if no new prisons are built and the 8000+ prisoners housed out of state are brought back to California.

California has stated in court filings that additional population reduction would threaten public safety and require the violation of state law. And it has argued that it is currently operating a constitutional prison system, implementing vast improvements in medical and mental health care. The State has sought termination of the Coleman order altogether, and modification of the population order in Plata. The court agreed to push off the final population benchmark till the end of 2013, but has written that it is not favorably disposed towards the state's motion to modify.

On April 11, 2013, the court denied the motion to vacate the order, holding that neither the facts or the law had changed since the last order and that the state was merely attempting to re-litigate an already decided claim. Additionally, the court held that the requirement for the state to propose a plan that would allow them to reach the maximum capacity did not constitute an additional requirement. 2013 WL 1500989. The court ordered the state to immediately take all steps necessary to comply with the order. The court also issued a separate order mandating that the state make a list of all reduction measures it planned on taking, to submit a plan for compliance, to use their best efforts to comply with the plan, to update the court on their progress and to develop on system to identify prisoners who were unlikely to reoffend in order to make them eligible for early release.

The state submitted a plan but it did not comply with the court's order, falling short of the threshold number set by the court by about 2,500 prisoners (out of approximately 9,000. As a result of this failure, the court, in a June 20, 2013 order, mandated that the state implement retroactive and prospective good time credits to prisoners and waived select state laws in order to reduce the prison population to the requisite 137.5% of maximum capacity. 2013 WL 3326872.
