On June 24, 2010, the United States filed a lawsuit in the U.S. District Court for the District of Minnesota, under the Fair Housing Act, 42 U.S.C. §§3601-3619, against owners and operators of an apartment complex located in Red Wing Minnesota. DOJ alleged that the defendants discriminated against the complainant, an African-American man, on the basis of race and sex when it refused to rent him a unit because of his criminal background, but rented an apartment to a white male with a felonious criminal background. The complaint sought declaratory, injunctive, and monetary relief.
Judge Nelson was elevated to the Court of Appeal, and the case was reassigned to Judge Donovan Frank. On July 29, 2011, Judge Frank approved a two year Consent Decree agreed to by the parties. The Consent Decree provides:
