On October 25th, 1991, four female food clerks filed a class action lawsuit, under 42 U.S.C. § 2000(e) and the Cal. Government. Code § 12940, against Safeway Stores, Inc. The plaintiffs, represented by private counsel, claimed that they were victims of sex discrimination evident by: the denial of promotions, including to full time, night shift, work on the retail floor, and management positions; denial of additional hours and desirable store, shift, and department assignments; and the denial of adequate training opportunities. The complaint, which we do not have a copy of, was originally filed in the Northern District of CA; however, the case was transferred to the Eastern District of CA on May 22nd, 1992.

On November 16, 1992, the court granted defendants' motion for summary judgment as to two of the named plaintiffs on grounds that their claims were time-barred.

On May 28th, 1993, the Court (Hon. William B. Shubb) granted partial summary judgment to the defendants. However, the two parties opted to settle, and moved for a preliminary approval of a consent decree which was subsequently granted on April 6th, 1994. Final approval occurred on June 28th, 1994, and the disbursement of a class action settlement fund was granted on January 3rd, 1995.
