On April 13, 2000, two private plaintiffs and the Equal Rights Center filed a lawsuit under 42 U.S.C. § 1981 against Kozmo.com, Inc. in the United States District Court for the District of Columbia.

On August 17, 2000, the plaintiffs, represented by private counsel, filed a motion to extend time for the filing of the class certification motion. Alternatively, the plaintiffs filed a motion for voluntary dismissal under FRCP 41(a)(2).

On August 30, 2000, the Court (Judge June L. Green) denied plaintiffs' motion to extend time for the filing of a class certification motion and granted plaintiffs' alternative motion for voluntary dismissal. The order dismissed the case without prejudice with each side to bear its own costs and attorney fees.
