On May 9, 1996, a female former employee of the University of Illinois at Urbana-Champaign filed a lawsuit under Title VII, the Equal Pay Act, and the Age Discrimination in Employment Act of 1967 in the Central District of Illinois against the University of Illinois at Urbana Champaign Cooperative Extension Service. The complaint alleged that the defendant (1) subjected the plaintiff to sexual harassment in violation of Title VII, (2) violated the Equal Pay Act, (3) subjected the plaintiff to age discrimination in violation of the ADEA, and (4) retaliated against the plaintiff in violation of Title VII.

On July 12, 1996, the defendant filed a motion to dismiss asserting several bases, including Eleventh Amendment immunity. The District Court (Judge Joe Billy McDade) sought input from the Department of Justice ("DOJ"), because the defendant attacked the constitutionality of Title VII, the Equal Pay Act, and the ADEA as the apply to the states. On October 8, 1996, the proceedings were stayed pending a response from the DOJ regarding its intentions to intervene. On January 22, 1997, the DOJ's motion to intervene was granted.

On July 11, 1997, the court granted in part and denied in part the defendant's motion to dismiss. The court found that none of the claims were barred by Eleventh Amendment immunity. Gehrt v. University of Illinois at Urbana-Champaign Cooperative Extension Service, 974 F. Supp. 1179 (C.D. Ill. 1997). The court also struck all claims for punitive damages.

The plaintiff filed an amended complaint on July 23, 1997.

In June 1999, the parties reached a settlement. The plaintiff moved the court to enforce the terms of the settlement agreement.

On August 20, 1999, the court granted the parties' stipulation of dismissal and dismissed the case.
