On July 14th, 1993, the United States Department of Justice ("D.O.J.") filed a lawsuit under Title VII, 42 U.S.C. § 2000e et seq., against Wright State University in the United States District Court for the Southern District of Ohio. The DOJ sought remedial relief, alleging that the defendant violated Title VII by subjecting a professor to unlawful retaliation.

Specifically, the DOJ charged that the professor was retaliated against for opposing what he reasonably believed to be discriminatory employment practices and for filling a charge with the EEOC. According to the complaint, the relaliation took the form of giving the professor low performance evaluations, decreasing the amount of his merit pay increase in 1990, withholding, or endeavoring to withhold, his performance evaluations, and failing or refusing to take appropriate action to remedy the effects of the discriminatory treatment.

On July 14th, a consent decree was entered. It stipulated general relief, including the prohibition of retaliation, and the required posting of notices in conspicuous places at the university of employees' rights under Title VII. Specific relief includes a monetary award representing retroactive salary increases with interest, and an increase of the movant's annual salary. The court retained jurisdiction for one year after the entry of the decree.

On July 16th, 1993, the court (Walter H. Rice) entered a consent judgment, dismissing the case (document not available).

On August 20th, 1993, the docket shows a notice/memorandum protesting the DOJ's handling of the case, filed by the movant. The DOJ responded on September 3rd, 1993. On September 28th, 1994, the court (Walter H. Rice) entered an order regarding the DOJ's handling of the case. None of these documents are currently available.

This case is closed.
