On August 7, 2007, the U.S. Department of Justice ("D.O.J.") filed a lawsuit under Uniformed Services Employment and Reemployment Rights Act of 1994, 38 U.S.C. § 4301 - 4333 ("USERRA"), against DTI Associates in the U.S. District Court for the Eastern District of Virginia on behalf of an employee who also served in the Navy Reserves. The D.O.J., alleging that defendant's failure to rehire the employee after his time serving in active duty, sought declaratory and monetary relief as well as reinstatement.

In October of 2001, the complaining party began his employment with the defendant. At the time he also maintained his status in the Navy. In January of 2002, he was deployed to fight in Iraq. He informed his employer that he was being deployed. After returning in September 2003, he asked for his job from the defendant. The defendant informed him that there were no available jobs at that time.

On October 11, 2007, the employee filed a notice of voluntary dismissal which the district court (Judge T.S. Ellis) then ordered the same day.
