On December 7, 1993, in the United States District Court for the Eastern District of North Carolina, the Justice Department filed a complaint alleging a pattern and practice of discrimination against female employees and applicants by the North Carolina Department of Corrections in male prisons in violation of Title VII of the Civil Rights Act of 1964. The complaint sought broad injunctive relief including job offers, back pay, retroactive seniority and other benefits to those who had been discriminated based on gender.

On February 8, 1996, Judge Terrence W. Boyle of the United States District Court for the Eastern District of North Carolina approved a partial settlement requiring defendants to pay a total of $6.8 million with $1.3 million going to a new organizational structure for the prison system and the remaining $5.5 million for the class of women who applied for jobs or were employed between December 31, 1983 and December 31, 1992.

On September 10, 1999, Judge Boyle approved an injunctive consent decree with a three year duration. The monetary relief of the previous settlement remained unchanged. Additionally, the state agreed to create a sexual harassment prevention program, to comply with equal employment practices and to apply priority hiring and promotion for females in the form of 464 new hires and 35 promotions.
