On November 13, 1986 the International Longshoremen's and Warehousemen's Union filed suit under the Administrative Procedure Act, 5 U.S.C. § 701 et seq. in the United States District Court for the Western District of Washington to challenge an Immigration and Nationalization Service decision which allowed Canadian crane operators on board logging ships to enter the United States as "alien crewmen" rather excluding them as "alien workers."
The United States District Court for the Western District of Washington, Barbara J. Rothstein, Chief Judge, concluded that the operators were properly allowed entry into the United States as alien crewmen, and Union appealed.
The District Court (Judge Barbara J. Rothstein) denied the Union's motion for a preliminary injunction and granted summary judgment in favor of the government, concluding that the crane operators were properly classified as alien crewmen under the Immigration and Nationality Act, 8 U.S.C. § 1101(a)(15)(D)(i). Plaintiffs appealed.
The Court of Appeals (Circuit Judge, Boochever) reversed and remanded, holding that the operators were not "alien crewmen" within the meaning of the federal immigration laws. International Longshoremen's and Warehousemen's Union v. Meese, 891 F.2d 1374 (9th Cir. 1989)
