On May 5, 2006, an inmate suffering from Gender Dysphoria (GD) filed a lawsuit in the Superior Court of Orange County, California, challenging the failure of the Orange County Sheriff's Department and the Orange County Health Care Agency to provide him with medically necessary hormone therapy and treatment while he was incarnated. Plaintiff, represented by the Transgender Law Center, alleged that, in addition to being deliberately indifferent to his serious medical needs, Defendants subjected him to ridicule, and harassment. He sought monetary and injunctive relief.
On June 27, 2007, the parties entered into a settlement agreement, which, among other things, called for the Orange County Sheriff's Department and the Orange County Health Care Agency to implement several written policy reforms regarding the administration of hormone replacement therapy to Orange County Jail inmates that had been diagnosed with GD. The agreement required the County to provide mandatory continuing education to all sheriff deputies and county healthcare workers regarding transgender issues. The County also agreed to issue a county-wide anti-discrimination policy which included gender identity and transgender persons as a protected class. Lastly, the defendants paid Plaintiff monetary damages in the amount of $49,000.00.
