Plaintiffs alleged that Defendant-insurance company engaged in redlining when denying their application for homeowners' insurance. Plaintiffs filed suit the U.S. District Court for the Southern District of Ohio, alleging that insurance redlining violated the Fair Housing Act, 42 U.S.C. §§ 3601-3619. On August 1, 1984, U.S. District Court Judge Rice denied the Defendant's motion to dismiss, finding that a denial of insurance based on the race of a homeowner could constitute a violation of the FHA. McDiarmid v. Economy Fire & Casualty Co., 604 F. Supp. 105 (S.D. Ohio 1984).
