Plaintiffs, white home-sellers, their real estate agent, and a community organization, brought suit in the U.S. District Court for the Northern District of Ohio under federal civil rights statutes, 42 U.S.C. 1981, 1982, and 1985(3), and the Fair Housing Act, 42 U.S.C. 3601-3619. Plaintiffs sought both monetary damages and injunctive relief. Plaintiffs alleged that the two Defendant-lenders appraised the home-seller's home below its market value because of the racial composition of the neighborhood and engaged in a redlining conspiracy.
On July 22, 1987, U.S. District Court Judge Richard B. McQuade, Jr. grant in part and denied in part the Defendant-lenders' motions for summary judgment. Old West End Assoc. v. Buckeye Federal Sav. & Loan, 675 F. Supp. 1100 (N.D. Ohio 1987). Judge McQuade found that there was insufficient evidence to establish a prime facie case of lending discrimination against one of the lenders and granted that Defendant-lender's motion for summary judgment. Judge McQuade also dismissed the conspiracy claim. However, Judge McQuade denied the second lender's motion for summary judgment, finding that the Plaintiffs had established a prime facie case of lending discrimination that could not be resolved at the summary judgment stage.
