Plaintiff-loan applicant sued Defendant-bank on July 12, 1993, in the U.S. District Court for the Northern District of Illinois, alleging violations of the Fair Housing Act, 42 U.S.C. 3605, and the Equal Opportunity Credit Act, 15 U.S.C. 1691(a)(1). When Plaintiff applied for a loan with Defendant, one of Defendant's agents commented that the neighborhood in which Plaintiff lived had declined in recent years; the Defendant subsequently denied Plaintiff's loan application, purportedly because of Plaintiff's poor credit history.

On June 12, 1996, U.S. District Court Judge James B. Zagel granted the Defendants' motion for summary judgment on both the ECOA and FHA claims. Saldana v. Citibank, 1996 U.S. Dist. LEXIS 8327 (N.D. Ill. June 12, 1996). Judge Zagel found that Plaintiff's purported evidence of illegal discrimination was insufficient to create a prima facie claim under either statute. After Plaintiff filed an appeal, the parties settled the case and voluntarily dismissed the action on December 20, 1996.
