On February 3, 2005, Plaintiff Richard Castellini, who was sentenced to 21 months in prison for money laundering with a recommendation that his sentence be served in the federal boot camp program, filed a lawsuit in the U.S. District Court for the District of Massachusetts, seeking a temporary restraining order and/or preliminary injunction to prevent the Federal Bureau of Prisons from terminating the boot camp program. Plaintiff alleged that the Bureau of Prisons violated the Administrative Procedure Act ("APA"), 5 U.S.C. § 553, and the Ex Post Facto Clause, U.S. Const. art. I, § 9, cl. 3. when it announced that it was terminating the boot camp program due to budgetary pressures.

On April 12, 2005, the District Court (Judge Patti B. Saris) issued a preliminary injunction, enjoining the Federal Bureau of Prisons from terminating Shock Incarceration until it had complied with the Administrative Procedure Act and in good faith considered plaintiff's eligibility for the Program. After the injunction was issued, the parties initiated settlement discussions. On June 23, 2005, the parties filed a stipulation for dismissal with the Court. The terms of the settlement are unknown as the agreement was not filed with the Court.
