On April 21, 1992, Steven Douglas Hill filed a federal habeas corpus petition and application for stay of execution in the United States District Court for the Eastern District of Arkansas. Hill had been sentenced to death by a jury in 1985 and raised several previous appeals and one previous habeas corpus claim. One of Hill's claims was that Arkansas' method of execution by lethal injection violated the Eighth Amendment's protection against cruel and unusual punishment. Previous executions in Arkansas had been performed by individuals who were not medical doctors. Hill was represented by a private attorney.

The district court (Judge Henry Woods) held that the absence of a physician at an execution was not a constitutional violation. Hill v. Lockhart, 791 F.Supp. 1388 (E.D. Ark. 1992). The United States Court of Appeals for the Eighth Circuit affirmed the decision on June 2, 1993.
